The Government of India is leading an important higher education related initiative to improve efficiency and effectiveness of the technical education management system. This initiative, “Technical Education Quality Improvement Programme (TEQIP)” is being executed with the support from World Bank. The Programme aims to improve quality of technical education and enhance existing capacities of the institutions to become dynamic, demand-driven, quality conscious, efficient and forward looking, responsive to rapid economic and technological developments occurring both at national and international levels.
As part of the efforts by SPFU Karnataka, the member colleges of TEQIP Karnataka are planning to introduce a course on Intellectual Property Rights (IPR) for students in 2009. To that end, three workshops were organized in collaboration with Xellect IP Solutions to train the faculty so that they will then be well equipped to teach the students and also to help in doing better research.
The three workshops were held at:
First Workshop: Dec 1-5, 2008 MSRIT, BangaloreSecond Workshop: Jan 5th-9th, 2009 SDM, DharwadThird Workshop: Feb 2nd-6th, 2009, SJCE, Mysore
57 teaching faculty from 14 engineering colleges from the State of Karnataka participated in these workshops on IPR under this Project.
FIRST WORKSHOP: Dec 1-5, 2008 MSRIT, Bangalore
The Workshop Series on ‘Comprehensive and Practical Approach to Intellectual Property Rights : Ensuring synergy between Technology and Law’ was inaugurated by Dr. N Nagambika Devi, IAS, Directorate of Technical Education, Ministry of Education. In her Inaugural Address Dr Nagambika highlighted the need of upgrading our knowledge base on emerging fields like IPRs as they are becoming a key aspect of economy and society. The Inaugural Session was addressed by key representative of Industry. Mr. N.Srinivasan, Former Director General, Confederation of Indian Industry and member CII IQ Advisory Council & Special Advisor made an excellent and very relevant speech at IPR workshop. He mentioned that in today’s global scenario, one should take care of the following 7C’s

- Customer
- Creativity
Intellectual Property Rights foster creativity and ensure the benefits reach the market and society and hence need to utilized effectively.
Industry speakers from GE Research Centre and Philips India also shared their valuable perspective on why IPRs are important to corporates and how these organizations make effective use of IPRs. The Inaugural session was also attended by Mr H U Talawar, OSD, SPFU and Principal, MSRIT College, the host Institute. The opening remarks was given by Dr. Rajanikanth, Principal, MSRIT, and the Vote of Thanks was given by Vice-Principal, MSRIT.
The IPR Head of Crompton Greaves, Dr. Vivek Singal provided a case study on how they have evolved a corporate IPR Policy to create awareness on IPRs and encourage filing of relevant IPRs in the company.
Participants were taken through a brief History of IPRs and Introduction to IPRs that covered the basics of different forms of IPRs- Copyrights, Designs, Trademarks, IC Layout Design, Geographical Indicators, and Patents by Xellect IP Solutions.
Different aspects of patents were dealt with in more dealt with in more detail in subsequent sessions. Industry speakers were brought in to provide expert talk on the three tenets of Patentability that included speakers from Hindustan Unilever Research India, who spoke about Patents with an Indian perspective and very detailed presentations on essential criteria that determines the fate of a patent application- novelty, non-obviousness and statutory bars. The US scenario was taken up by another industry speaker from Novo Nordisk that covered patent regime with US perspective and differences that exists between US patent regime and others. The EU perspective was covered by Xellect IP Solutions. The message was that patent regimes are country specific but do have broad similarities. The participants were then briefed about the patent contents and patentable matter by Xellect IP Solutions. Exercises were provided to the participants for identifying critical information in a patent document. Exercises were reviewed and the interpretations were discussed in detail. The participants were then taken through a session on Industrial design by Xellect IP Solutions as this is also very relevant for engineering fields. This was followed by sessions by Xellect IP Solutions on need for documentation and the risk of public disclosure and several best practices were shared with the participants.
These sessions were followed by case-scenario exercises with different scenarios involving innovative concepts. The learnings from previous lectures on patentability, patentable subject matter, public disclosure etc were tested through these examples. These were followed by session by Xellect IP Solutions on “Third Party Involvement” and “Agreements”.
The participants were introduced to the subject of “Patent Drafting” by Xellect IP Solutions and later by the industry speaker from Siemens. This included several examples to illustrate key aspects needed for drafting a good patent document.
The participants had another session with a patent and intellectual property consultant on understanding patent documents. Some key patents were discussed and participants were involved in drafting examples and exercises.
The first workshop concluded on this note and participants knowledge-base on IP and patents was enhanced. The participants were given a take-away exercise on an invention, and were asked to come prepared with the novel features of the invention and their ideas for drafting this as a patent application.
Second Workshop:Jan 5th-9th, 2009 SDM, Dharwad
The second part of 3-part series of the IPR Workshop commenced at SDM College of Engineering & Technology, Dharwad. The participants were taken through a re-cap of the key learnings in the previous Workshop. This was followed by a mock inventor interview exercises conducted as role-plays by Xellect IP Solutions around the invention provided to the participants in the first take-away exercise. This was aimed at providing insights on how and what information is critical for explaining the inventions by researchers/inventors so that the invention can be adequately protected. This was followed by a session on “Presenting the Invention” by Xellect IP Solutions which covered the points to be included in a document describing an invention and presenting the same to others including patent attorney and Patent Office. The participants were then walked through in detail on how to effectively claim an invention, formulating main and dependent claims. A very detailed analysis of adding/removing a word/phrase into the claim and its overall implication was carried out through actual examples. Different kinds of claim approaches were discussed and explained by Xellect IP Solutions. Followed by claim development and analyses, drafting other sections of a patent document were dealt with in detail with examples. Patent Prosecution i.e. the examination of the patent application by the Examiner and defending one’s patent application in view of the concerns raised by the Examiner was dealt with in a session on Patent Prosecution by Xellect IP Solutions. The session introduced terms such as Office action, Office Action Response, prosecution history, Estoppel. The participants were given case-scenarios that included the claims of different inventions, related prior art for each case and the Examiner’s objections for each case. How to handle each of these situations was illustrated in sufficient detail by Xellect IP Solutions.Next, the participants were introduced to another important aspect of Patent Searching by the representative of Patent Facilitating Cell, TIFAC, DST. Entire process of patent searching was explained including how different is patent search from general search, and search tools, databases and strategies. In a step-by-step manner the participants were taken through how to start and go on narrowing patent search process. After patent searching, the next step of patent analyses is equally important and reveals interesting trends and technology gaps. This aspect was explained in detail by an industry expert from Shell India who brought to fore different types of analyses for different scenarios. The second workshop concluded with a wholesome knowledge about patent- drafting, searching and analyses. Second take-away exercise was provided to participants that involved a practice of conducting patent searching and getting relevant information.
Third Workshop: Feb 2nd-6th, 2009, SJCE, Mysore
The third part of 3-part series IPR workshop started today at SJCE, Mysore. The participants were provided with a refresher session by Xellect IP Solutions on patent searching and analyses to maintain the continuum from the Second Workshop. The analyses process and claim mapping was discussed in detail and the second take-away exercise was discussed.
The rest of the week sessions focussed on detailed sessions on other forms of Intellectual Property Rights that included Copyrights, Trademarks, Plant Variety Protection, Semiconductor IC Layout Design protection, Protection of Traditional knowledge. Several experts from leading IP Firms and Government shared their expertise in these areas. The participants were also taken through the sessions on special areas of IP in Information Technology and IP in Biotechnology by Xellect IP Solutions.
Following these sessions, the participants were given presentations on IP Strategies, IPR Policy and discussion on Syllabus formulation.
The last day of the IPR Workshop series brought to the participants an interaction with Mr T V Madhusudan, Asst. Controller, Patent Office Chennai, who provided an excellent insight into the working of the Patent Office and special provisions of the Indian Patent Law. Funding for Patent filings was elaborated by R. Saha, a senior Government Official from Department of Science and Technology.
The Valedictory Session was chaired by Dr B G Sangameshwar, Principal, SJCE, with Chief Guests Dr R Saha, Director, PFC, Department of Science and Technology and Mr T V Madhusudan, Asst. Controller, Patent Office Chennai. All the signatories recognized the importance of this initiative and encouraged the participating engineering colleges to keep the momentum and take concrete steps to foster an innovative culture in the institute and disseminate knowledge on IPR related matters. The Participants were felicitated by a Certificate of Completion awarded to them from Dr N Nagambika Devi, IAS, Director, Directorate of Technical Education and Mrs Rachna Singh Puri, CEO Xellect IP Solutions.
